Terms of sale, delivery and payment

In connection with the obligations to provide information under Article 4 of the E-Commerce Act, Megaclean Ltd. provides the following information:

Missing / Damaged items

Please check your delivery upon receipt. Any missing or damaged goods must be reported to us by telephone within 2 working days of receipt of goods. We may not be subject to a charge or refund after this period.
Our orders are checked, inspected and packed very carefully before being shipped.

1. Validity

These terms and conditions govern the activities of Megaclean Ltd / BG102128188, registered office and registered address. Burgas, ul. Petko Voyvoda 6A /, including https://hygiene.bg , related to the sale and delivery of goods to the customer. “Megaclean reserves the right to modify these terms and conditions at any time by updating this text; the customer shall comply with such modifications or revisions.

2. Contract with client

The contract between Megaclean and the customer comes into effect when Megaclean accepts the customer’s order, i.e. when payment is received. “Megaclean has the right to withdraw from the contract in the event of obvious typographical or arithmetical inaccuracies appearing on Megaclean’s website.

3. Prices and availability

The prices of the goods are listed on the Megaclean website. The price as shown is inclusive of VAT (at the standard rate for the Republic of Bulgaria). There will be an additional delivery charge. Orders are subject to availability. In the event that goods are not available, customers will be notified by email. Price and availability information is subject to change without notice. Prices are valid only when ordering through the online store. Photos are illustrative.

4. Delivery of the goods

“Megaclean will deliver the ordered goods to the delivery address specified by the customer. Subject to availability, all orders paid for by credit card will be dispatched immediately. “Megaclean has the right to ship orders in parts. Shipment of the goods shall constitute performance of the contract.

5. Guarantee of “Megaclean”

If the goods delivered are not what the customer ordered or are the wrong quantity or are damaged or defective, and if the customer returns them within seven days, Megaclean will, at the customer’s option, either refund in full or, where possible, make good the shortfall or failure to deliver or replace any damaged or defective goods.

The minimum warranty period for any product purchased by an individual is 2 years and by a legal entity 1 year.

6. Return Policy – 100% Money Back Guarantee

All goods purchased from Megaclean can be returned for a refund within 7 working days of receipt of delivery under Article 55 of the Consumer Protection Act.
Before sending a parcel back to us, please contact us by email at market@hygiene.bg or call us on 0895566356. You will be asked to state the reason for the return and whether the item has been used. In addition, you will need to confirm your name, order number and postcode, so please provide these. You will need to include the order number with the parcel you are returning to us, as failure to do so may result in a delayed refund. Please further note the following:

1. You must look after our goods whilst they are in your possession and any item for return must be received back in its original delivered condition and original packaging. Items must not be damaged or used and must be in suitable condition for resale. All original packaging must accompany each returned item. We cannot accept returned goods for a refund if such goods are removed from sealed packaging. All items will be inspected upon return to our warehouse.

We are not the manufacturer so all product and packaging must be returned in the same condition as you would have received them and as you would expect to receive them. If the product or packaging is missing or damaged in any way, we will not be able to refund you.

2. You or your carrier are responsible for returned goods until they reach our warehouse. The cost and risk of returned goods will be at your own expense and we strongly recommend that you obtain proof of postage or use the service of a reputable freight forwarding company.

3. We regret that money for outgoing shipments, packing and insurance cannot be refunded.

4. We try to refund within one week of receipt of the goods back to us, but we still promise to refund all amounts within 30 calendar days of receipt of the goods in our warehouse. Please note that we will not be held liable to pay any interest that may arise in the event that any refund is made outside the terms of your credit/debit card.

5. Please return goods to the address at the top of the receipt/invoice and include the return authorization number. Any returned products that do not contain this information may be significantly delayed.

6. Any returned goods we receive that do not comply with this Returns Policy will be designated as “Disputed”. These Disputed Items will not be subject to refund. The reason for this decision will be given. We would be happy to return such Disputed Items to you at your expense, otherwise they will be destroyed within 91 calendar days of receipt back to us.

7. We are sorry, but due to false promises in the past, we cannot replace an item until the original is returned to the Megaclean warehouse. If you need an item urgently, we suggest you place a second order for the new item and return the first one to us later.

8. Occasionally, and especially if the goods are purchased in advance as a gift or delivered during a holiday, the above seven-day response period may be missed. Therefore, without prejudice and as a gesture of goodwill, we would be pleased if you would consider the following measures on a case-by-case basis:

If an item is unclaimed and is returned and received by us between 7 working days and 30 calendar days, we will happily accept it and refund 60% of the sale price (excluding delivery charge)
If the item is returned and received after 30 calendar days, we are under no obligation to refund the money. If you would like the goods to be re-sent to you, we will charge you the additional amount for shipping costs.
[*] “7 working days from receipt of delivery” is defined as the date on which the parcel is received by you, being the date you sign that the parcel has been received by you.
9. We do not refund money for goods included in special orders or at preferential prices for customers.

7. Applicable law and jurisdiction

Contracts between Megaclean and the client will be in accordance with Bulgarian law and all disputes will be subject to the exclusive jurisdiction of the Bulgarian courts.

8. Intellectual property

All information, data, text, graphics, links or computer code published on, contained in or available from this website (the “Material”) is the property of Megaclean. Any unauthorized use of materials, including production, storage, modification, distribution or republication without the prior written consent of Megaclean or, where applicable, the applicable copyright owner, is prohibited. Megaclean’s names and logos and all related product and service names, design marks and slogans are trademarks, service marks or trade dress of Megaclean and may not be used without Megaclean’s prior consent.

9. Rejection

Megaclean, to the fullest extent permitted by law, hereby disclaims all warranties and conditions in relation to the Material and all goods and services provided in connection with this Website, whether express or implied or statutory (including all implied warranties and conditions of merchantability and fitness for a particular purpose).

In no event shall Megaclean be liable for any indirect, punitive, special, incidental or consequential damages, even if Megaclean has been advised of the possibility of damages, including, but not limited to, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of this site, interruption or delay of this site, the provision or non-provision of services, or of any information, material, goods and services obtained through this site or otherwise arising out of the use of this site, whether in contract, tort or otherwise to the fullest extent permitted by law.

10. Invalidity of terms and conditions

If for any reason any of these terms and conditions are not in force, the validity of the remaining terms and conditions will not be affected

“Megaclean is committed to protecting your privacy. Please read the following to understand how your personal information is processed. If we decide to change our privacy policy, we will post those changes on this page so that you will always be aware of what information we collect, how we use it, and under what circumstances we disclose it.

Your personal information

When you place an order, we collect the following information from you – name, address, telephone number and email address. We do not use credit/debit card details. This information allows us to process and fulfil your order and send you confirmation of the order details.

Use of your personal information

“Megaclean will use the information you provide for marketing purposes and to notify you of improvements to our online store. We would like to keep you informed about our products and services and notify you of special offers we think may be of interest to you.

However, we will not provide your data to other organisations. Your information is stored solely for the purpose of fulfilling your order, processing payments, and sending you the latest Megaclean information. If you do not want to be informed about new offers of “Megaclean”, please send us an email to: market@hygiene.bg

Delivery time: up to 48 hours. If the goods are available.

Payment method:

– cash on delivery / PPP for delivery with forwarding company;

– in cash against invoice;

– by bank transfer – the amount is transferred to the company’s account and after confirmation of the transfer by the bank the goods are delivered to the specified delivery address, accompanied by an invoice.
